1. IntroductionWOIPS is an online, software-based intellectual property platform providing AI-assisted tools for patent drafting. WOIPS operates solely as a software tool and does not act as a patent attorney, legal advisor, or representative before any patent office. By accessing or using the WOIPS platform, you agree to be bound by these Terms and Conditions.
2. Legal StatusWOIPS operates under the legal name WOIPS and is currently provided on a freelance service basis.
3. Scope of ServicesWOIPS provides AI-assisted tools designed to help users draft patent-related documents in accordance with international standards. At present, the only active service is the "Prior Art Search" service, which assists users in identifying existing knowledge relevant to their inventions. The service includes structured guidance for patent descriptions, drawings, and claims to ensure internal consistency.
WOIPS does not guarantee:
• Patent grant or acceptance by any authority
• Legal validity or enforceability of any document
4. User ResponsibilityUsers are solely responsible for:
• The accuracy, completeness, and legality of the information provided
• Correct use of the software tools
The effectiveness of the service depends substantially on the quality of user-provided input.
5. No Legal or Professional AdviceWOIPS does not provide legal advice, patent prosecution services, or professional representation. Use of the platform does not create any attorney-client or consultant-client relationship.
6. Intellectual Property Rights
• All user-provided data and AI-generated outputs are the exclusive property of the user.
• WOIPS does not claim any ownership, license, or usage rights over user content or outputs.
• WOIPS shall not use user content for demonstration, training, marketing, or any other purpose.
7. Payments and Pricing
• Services are offered through a token-based system.
• Prices include applicable Value Added Tax (VAT).
• Refund within 14 days of the original purchase date.
8. Limitation of LiabilityTo the maximum extent permitted by law, WOIPS's total liability shall be limited to the amount paid by the user during the twelve (12) months preceding the claim. WOIPS shall not be liable for indirect, incidental, or consequential damages.
9. Availability and ModificationsWOIPS may update, modify, or discontinue parts of the service at any time. These Terms may be updated periodically, with continued use constituting acceptance.
10. Governing Law and Dispute ResolutionThese Terms shall be governed by the laws of the European Union and the Federal Republic of Germany. Any dispute arising out of or in connection with these Terms shall be finally resolved by arbitration under the rules of the German Chamber of Commerce.
11. Prevailing LanguageIn case of any inconsistency, the English version of these Terms shall prevail.
